A process server is an individual who delivers intended legal documents to the intended party. Process servers handle documents such as subpoenas, summonses, court orders, and complaints. They ensure that the recipient acquires a copy of the necessary document. Each state maintains different legislation regarding the process of serving legal documents. In some states, a process server will be required to deliver the documents directly to the defendant. In other states, he/she will be permitted to leave the documents with a family member of the defendant.
A process server must obtain proof that necessary documents were successfully delivered to the intended party. This is achieved by completing a Proof of Service document. Process Servers possess an important role within the legal domain, as an individual cannot be held liable for violating a court order or legal document if he/she was not properly served this document.
